These Terms of Service (“Terms”) govern use of https://kuuulcow.com and purchases from Kuuul Cow LTD (“Kuuul Cow,” “we,” “us,” or “our”).
By accessing our website, purchasing a product, or using our services, you agree to these Terms, subject to any mandatory rights that cannot legally be waived.

Where age restrictions apply to a transaction, promotion, or service, you must satisfy the applicable age requirement.
Giveaway eligibility is governed separately by the applicable Official Giveaway Rules.
3. PRODUCTS AND DIGITAL CONTENT
We make reasonable efforts to display product descriptions, images, colours, sizing, features, and pricing accurately.
Actual colours or appearance may vary depending on screens, manufacturing, printing, photography, or other factors.
Products may be modified, discontinued, substituted, or become unavailable without notice, subject to orders already accepted and applicable law.
Digital products are licensed or provided for the personal-use purposes described with the applicable product and may not be resold, redistributed, reproduced commercially, or used beyond the rights expressly granted.
4. ORDERS
Submitting an order does not necessarily mean the order has been accepted.
We may decline or cancel an order before fulfillment where reasonably necessary because of:
- Product unavailability;
- Pricing or listing errors;
- Suspected fraud;
- Unauthorized payment activity;
- Technical errors;
- Duplicate or abusive orders;
- Legal requirements; or
- Another legitimate business reason.
If we cancel a paid order, we will provide an appropriate refund where required.
5. PRICING AND PAYMENT
Unless otherwise stated, prices are shown in Canadian dollars (CAD).
Applicable taxes will be calculated as required.
Payment processing may be provided by Shopify or another authorized payment provider.
You represent that payment information supplied for an order is authorized and accurate.
6. DISCOUNTS AND PROMOTIONS
Discounts, promotional codes, sales, and special offers may be subject to additional conditions.
We may correct or reject promotional use resulting from a clear technical error, unauthorized manipulation, fraud, or use contrary to the applicable promotional terms.
7. PROMOTIONAL GIVEAWAYS
Kuuul Cow LTD may operate promotional giveaways from time to time.
The KCG#1 Launch Special and any other promotional Giveaway offered by Kuuul Cow LTD are governed by the applicable Official Giveaway Rules.
For KCG#1, matters including:
- Eligibility;
- Qualifying purchases;
- Entry calculations;
- Upward rounding of eligible purchase amounts;
- Promotional multipliers;
- Digital-product bonus entries;
- Mail-In Alternate Method of Entry;
- Promotional requests;
- Entry cancellation or recalculation following transaction reversals;
- Odds;
- Independent winner selection;
- Skill-testing requirements;
- Winner verification;
- Prize selection; and
- Prize fulfillment
are governed by the Official Giveaway Rules:

If these Terms conflict with the applicable Official Giveaway Rules on a Giveaway-related matter, the Official Giveaway Rules control for that matter.
No purchase is necessary to enter a Giveaway where the applicable Official Rules provide a No Purchase Necessary entry method.
8. RETURNS, REFUNDS AND EXCHANGES

Unless applicable law requires otherwise, purchases may be final sale as described in that Policy.
Any effect a cancellation, refund, reversal, or chargeback has on Giveaway entries is governed by the applicable Official Giveaway Rules.
9. SHIPPING
Customer merchandise orders are subject to our Shipping Policy.
We currently ship qualifying customer merchandise orders within Canada, excluding Quebec, subject to availability and serviceability.
Prize fulfillment is separate from ordinary merchandise shipping and is governed by the applicable Official Giveaway Rules.
10. CUSTOMER INFORMATION
You agree to provide reasonably accurate and current information necessary to process your order.
You are responsible for reviewing:
- Product selection;
- Quantity;
- Size;
- Colour;
- Shipping address;
- Email address; and
- Other order information
before completing a purchase.
We cannot guarantee that an address or order can be changed once fulfillment begins.
11. FRAUD AND ABUSE
You may not use the website, store, payments, promotions, or Giveaway systems for fraudulent, deceptive, abusive, automated, or unlawful purposes.
We may investigate reasonably suspected:
- Fraud;
- Identity theft;
- Unauthorized payment activity;
- Promotion manipulation;
- Chargeback abuse;
- Automated activity;
- False accounts;
- Technical exploitation; or
- Attempts to interfere with Giveaway administration.
Any action we take remains subject to applicable law and the applicable Official Giveaway Rules.
12. INTELLECTUAL PROPERTY
Unless otherwise stated, Kuuul Cow LTD or its licensors own or lawfully use the content appearing on the website, including:
- Brand names;
- Logos;
- Graphics;
- Photography;
- Artwork;
- Product designs;
- Written copy;
- Digital products;
- Website content; and
- Other original material.
Nothing in these Terms transfers ownership of intellectual property to you.
You may not reproduce, distribute, sell, modify, commercially exploit, or create unauthorized derivative works from protected material except where expressly authorized or legally permitted.
Third-party trademarks remain the property of their respective owners.
13. THIRD-PARTY SERVICES
Our store may use or link to third-party platforms and services, including Shopify, payment providers, fulfillment providers, shipping providers, social-media platforms, analytics providers, banks, and other technology providers.
Those services may be subject to their own terms and policies.
Kuuul Cow LTD is responsible for its own obligations but does not control independent third-party platforms.
14. SHOPIFY
Our store is powered by Shopify.
Shopify provides ecommerce infrastructure but does not become the seller of Kuuul Cow LTD products merely because its technology is used.
Unless expressly stated otherwise, Shopify is not the sponsor or administrator of a Kuuul Cow LTD promotional Giveaway.

Our collection and handling of personal information are governed by our Privacy Policy:

16. CUSTOMER FEEDBACK
If you voluntarily provide ideas, suggestions, reviews, comments, or feedback, you grant us permission to use that feedback for legitimate business purposes, subject to applicable privacy, intellectual-property, and consumer laws.
Nothing in this clause transfers ownership of material where such a transfer would require additional consent or agreement.
17. ERRORS AND INACCURACIES
We may correct typographical, pricing, product-description, promotional, or technical errors where reasonably necessary.
If an error materially affects an already completed order, we will address the matter reasonably and in accordance with applicable law.
Giveaway entry-record corrections are governed by the applicable Official Giveaway Rules.
18. PROHIBITED USES
You may not use our website or services:
- For unlawful purposes;
- To violate intellectual-property rights;
- To transmit malicious code;
- To interfere with website security;
- To scrape or automate activity in a manner that harms the website;
- To manipulate payments or promotions;
- To impersonate another person;
- To submit false information; or
- To interfere with legitimate Giveaway administration.
19. WARRANTY DISCLAIMER
To the maximum extent permitted by law, the website and services are provided on an “as available” basis.
Nothing in these Terms excludes any warranty, condition, consumer protection, or remedy that cannot lawfully be excluded.
20. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Kuuul Cow LTD will not be responsible for indirect or consequential loss arising solely from circumstances outside its reasonable control.
Nothing in these Terms limits liability or remedies that cannot legally be excluded or restricted.
21. INDEMNIFICATION
To the extent permitted by law, you agree to be responsible for losses reasonably resulting from your material breach of these Terms, unlawful conduct, fraud, or violation of another person's rights.
This clause does not require you to indemnify Kuuul Cow LTD for its own negligence or misconduct where such liability cannot lawfully be shifted.
22. TERMINATION
We may restrict or terminate access to the website where reasonably necessary because of unlawful, fraudulent, abusive, or materially harmful conduct.
Termination does not extinguish rights or obligations that accrued before termination.
Giveaway participation and disqualification remain governed by the applicable Official Giveaway Rules.
23. FORCE MAJEURE
Kuuul Cow LTD is not responsible for delay or failure caused solely by circumstances beyond its reasonable control, including significant carrier disruptions, natural disasters, government action, major technology outages, labour disruptions, or similar events.
This clause does not eliminate rights that cannot legally be excluded.
24. GOVERNING LAW
These Terms are governed by applicable federal laws of Canada and the laws of the Province of Ontario, subject to mandatory laws applicable to the customer.
25. CHANGES TO THESE TERMS
We may update these Terms from time to time.
Changes will apply prospectively from the date they are posted unless applicable law requires otherwise.
Material changes will not be used to retroactively remove rights that have already accrued.
